I. INFORMATION NOTICE REGARDING THE PROCESSING OF PERSONAL DATA
Radbâță & Nicolae SPRL processes your personal data for the purpose of exercising the profession of lawyer, based on the provisions of art. 6 paragraph (1) of the General Regulation on the Protection of Personal Data no. 679/2016 of the EU (hereinafter referred to as GDPR). Personal data may be communicated to courts and other public institutions, as well as to natural or legal persons, in the course of exercising the powers conferred by Law no. 51/1995 regarding the organization and exercise of the lawyer profession.
Personal data will be stored for the period necessary to exercise rights and fulfil professional and financial obligations, the concerned person having the right to request access to data, rectification or erasing of data, restriction of processing, the right to oppose to processing, the right to data portability, within the limits of legal provisions, as well as the right to file a complaint with the National Supervisory Authority for the Processing of Personal Data.
Providing personal data represents a contractual and/or legal obligation, in the absence of their communication Radbâță & Nicolae SPRL being unable to exercise the specific duties of a lawyer and to properly exploit your right to defence.
The data provided are protected both by specific security means and by virtue of the lawyer’s legal obligation to preserve professional secrecy and implicitly to ensure the confidentiality of the entrusted data.
II. PERSONAL DATA PROCESSING POLICY
- PURPOSE AND FIELD OF APPLICATION
Radbâță & Nicolae SPRL, (hereinafter referred to as RN LEX) having its headquarters at Gloriei 1 St., 4th floor, bl. 322, apt. 10, Brașov, Brașov County, and secondary office at Paris 5 St., 1st floor, District 1, Bucharest, takes outmost care to the processing of personal data in conditions of safety, legality and transparency, in compliance with the principles provided by the GDPR.
This policy applies to personal data processed by RN LEX both through the website and to data communicated directly to the law firm.
Personal data is any information regarding an identified or identifiable natural person, such as, but not limited to: name, surname, signature, contract data, home address, e-mail address, phone number, any data from the ID or passport, family, professional or financial data, other data specific to the object of the file entrusted to the law firm.
- LEGAL GROUNDS FOR PROCESSING
Personal data, collected through this website, or in another way, are processed on the basis of one of the legal grounds below:
- conclusion and execution of the legal assistance contract;
- fulfilling a legal obligation of RN LEX;
- the need to protect your vital interests;
- performing a task that serves a public interest;
- your consent;
- the existence of a legitimate interest of RN LEX;
RN LEX will process the data communicated directly, in paper format or in electronic format, via e-mail or the website www.rnlex.ro
The data collected as a result of accessing the site and filling in the Contact form will be processed based on your consent, granted by ticking a box (opt-in consent).
- PURPOSE OF PROCESSING
Your personal data will only be processed for specified, explicit and legitimate purposes, respectively for:
- realization of your legitimate interest to benefit from legal assistance and representation;
- offering legal services in insolvency procedures;
- drafting of legal documents;
- attesting the identity of the parties, the content and the date of the documents presented for authentication;
- assisting and representing natural or legal persons before the courts and other public authorities;
- fiduciary activities carried out under the terms of the Civil Code;
- the temporary establishment of the headquarters for companies at the professional headquarters and their registration, in the name and on behalf of the client, of the parties of interest, the social parts or the shares of the companies thus registered;
- exercising the profession of lawyer by any means and ways specific to the exercise of the right of defence, under the conditions of the law;
- providing information by electronic means.
Regarding the data collected through this site, they will be processed to be able to respond to the requests made by you through the Contact form.
If it will be necessary for us to further process the personal data for a purpose other than that for which it was collected, we will provide you, prior to such further processing, with information regarding that secondary purpose and any relevant additional information.
- PROCESSING ACTIVITIES
The processing of personal data represents any operation or set of operations performed on personal data or sets of personal data, with or without the use of automated means, and the processing activities may consist of: collection, registration, organization, structuring, storing, adapting or modifying, extracting, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, restricting, erasing or destroying.
- DURATION OF PROCESSING
We will keep your personal data as long as necessary to fulfil the purposes for which the data are processed and according to the fiscal and professional legal provisions.
- DATA TRANSMISSION
RN LEX can transmit/communicate the personal data entrusted by you to courts and other institutions, to natural or legal persons (lawyers, experts, advisers, parties involved in your file) only for the purpose of executing the legal assistance contract and/or for the fulfilment of the duties provided by the Law of the lawyer profession. Personal data are not transmitted to other entities or persons from third EU countries where the GDPR is not applicable or to international organizations, but if this is necessary, you will be informed accordingly.
- YOUR RIGHTS
- the right to information – you have the right to be informed about the processing of personal data, as well as about the purposes of the processing and the duration of the processing if it can be determined, and about the rights conferred by the GDPR. The obligation to inform does not exist if the personal data must remain confidential on the basis of a statutory obligation of professional secrecy regulated by Union law or national law, including a legal obligation to preserve professional secrecy (e.g., for the opposite parties from the file).
- the right of access – you have the right to obtain a confirmation as to whether or not personal data concerning you is being processed and, if so, access to the data. The right of access is not absolute, and can only be exercised with respect for the rights and freedoms of other people.
- the right to rectification – you have the right to obtain the rectification of inaccurate data or the completion of incomplete data. In the event that the previously provided data undergoes changes (change of name, home address, e-mail address), please inform us of this.
- the right to data erasing – you have the right to obtain the deletion of personal data in the following situations: if the data are no longer necessary to fulfil the purpose for which they were collected, if you have withdrawn your consent and this was the only basis for the processing, or if the processing is against the law. The right to delete data does not apply if their processing is necessary for the fulfilment of a legal obligation or for the fulfilment of a task performed in the public interest. The withdrawal of consent does not affect the legality of the processing carried out prior to its withdrawal.
- the right to restriction of processing – you have the right to obtain the restriction of processing in the following cases: for the period until the accuracy of the data is verified, if it is contested by you, if the processing is contrary to the law, or if the law firm no longer has need the personal data for the purpose of processing, but the data subject requests them for the purpose of defending a right in court or in the case of exercising the right to opposition, or for the period in which it is verified whether the legitimate rights of the operator prevail over those of the data subject.
- the right to data portability – you have the right to receive the personal data that concern you and that you have provided, if the processing is carried out by automatic means (the data is in electronic format). This right does not apply to processing necessary for the performance of a task performed in the public interest.
- the right to object – you have the right to object at any time to the processing of your personal data. The exercise of this right must be based on the particular situation in which you are and cannot be exercised in the situation where RN LEX proves that it has legitimate and compelling reasons that justify the processing and which prevail over your rights and freedoms, or in the situation where the purpose is to establish, exercise or defend a right in court.
- the right not to be subject to a decision based solely on automatic processing, including profiling – RN LEX does not make decisions based on automatic processing.
- the right to file a complaint with the National Supervisory Authority for the Processing of Personal Data.

- DATA PROCESSING SECURITY
RN LEX processes your personal data with a full sense of responsibility, taking the necessary technical and organizational measures to ensure a level of security corresponding to the potential risks for the rights and freedoms of natural persons, to protect you against illegal or unauthorized access or use, as well as against accidental data loss or damage.
The security measures taken include, among others, the pseudonymization or encryption of personal data, the ability to ensure the confidentiality, integrity, availability and continued resilience of processing systems and services, the ability to restore the availability of personal data and access to it in a timely manner in the event of an incident of a physical or technical nature, a process for testing, evaluating and periodically assessing the effectiveness of technical and organizational measures to guarantee the security of the processing.
